1. Agreeing to these terms

When you sign up for TilDawn, you agree to this document. Some of it is legally required to be here (that’s what the parentheses with the actual legal terms are for). If there’s something you can’t agree to, don’t sign up — or delete your account from Settings and we’ll remove your data.

These terms are an agreement (contract) between you and Pixelated Vectors LLC. By tapping “Agree” at signup you accept them. If any part of this document conflicts with our Privacy Policy, the Privacy Policy wins on anything privacy-related; these Terms win on everything else.

2. Who can use TilDawn

You must be at least 16 years old. If your local law sets a higher age for binding contracts or data processing consent, that higher age applies to you instead. You also need to have legal capacity to agree to these terms in the place where you live, and you must not be barred from using our services by applicable law.

TilDawnis designed for one person per account. Sharing accounts breaks a lot of features (the timezone math, the Cooling Filter, the streaks), so please don’t.

3. Your account

You are responsible for keeping your password safe and for everything that happens under your account. If you notice anything you didn’t do — a login from somewhere odd, letters you didn’t send — email us at hello@tildawn.app and we’ll help. Don’t let anyone else sign in as you.

You can edit your account (exercise your right to rectification) anytime in Settings, and you can delete it whenever you want.

4. What you can’t do (acceptable use)

The rules below are non-negotiable. Breaking them can get your account suspended or terminated, with or without notice depending on severity.

• No harassment, threats, or abuse — directed at your partner, at us, or at anyone else who touches the service.
• No illegal content. No child sexual abuse material. No content that depicts anyone (including your partner) without their consent.
• No using live location to monitor or track someone who hasn’t knowingly opted in, or who has revoked. Location sharing in TilDawn is opt-in and reversible; bypassing that is a breach.
• No scraping, crawling, scripting, or automating access to the service.
• No reverse-engineering or circumventing the Cooling Filter to send content the filter would otherwise catch.
• No abusing the invite system to spam or impersonate.
• No attempting to access another couple’s data, or to extract data you aren’t entitled to.
• No using the app for commercial purposes (selling, advertising, market research) without our written permission.

We don’t actively scan the content of your messages for moderation. We do respond to reports, and we do take action when we learn something has crossed a line.

5. Your content

Everything you create in TilDawn— letters, photos, voice notes, capsules, doodles, list items, notes — belongs to you. You keep copyright and all other rights you already had.

For the app to work, you grant us a worldwide, royalty-free, non-exclusive license (a limited right, not a sale) to store your content, to display it to you and your partner inside the app, to process it through systems like the Cooling Filter when you ask, and to back it up. This license is scoped strictly to running the service. We don’t use your content for ads, marketing, or model training.

The license ends automatically when you delete the content or your account. Partner-facing copies follow the same rule — if you delete a letter, it goes from both sides.

6. Subscriptions and payment

TilDawn has a free tier and a paid Premium tier. When we wire purchases through the App Store, the product IDs will be tildawn_premium_monthly and tildawn_premium_annual.

Subscriptions are billed to your Apple ID and renew automatically (auto-renewable subscription) at the end of each period unless you cancel at least 24 hours before renewal. Prices are shown in the App Store and may vary by region.

Free-tier features include the basics. The Premium tier currently unlocks Time Capsules beyond the first, Watch Party, the Sentiment Dashboard, Year in Review outside its December launch window, and Unlimited Shared Lists (free tier gets up to 3 per relationship). We may add or adjust these over time; material changes are communicated in-app.

Refunds for App Store subscriptions are handled by Apple under Apple’s refund policy — not by us. You can request a refund at reportaproblem.apple.com.

7. Cancelling and ending the agreement

You can cancel anytime.For subscriptions: Settings app → your Apple ID → Subscriptions → TilDawn→ Cancel. For your account: Settings → Privacy → Delete Account. Cancelling a subscription leaves your account intact; deleting your account removes everything.

If you’re in the EU, EEA, or UK, you have 14 days to cancel a new subscription for a full refund (right of withdrawal, Directive 2011/83/EU). By beginning to use Premium features, you agree that the service has begun and waive this right for work already performed — standard for digital services — but you can still cancel future renewals.

We may suspend or terminate your access if you breach these terms or use the service in a way that creates legal or security risk. For material breaches we’ll give you 7 days’ notice where it’s safe to do so; for anything involving illegal content, child safety, or acute harm we may act immediately.

8. What we promise (and don’t)

We build TilDawn with care. We test it, we monitor it, we fix it when it breaks. But the service is provided as is and as available.

We don’t guarantee that the app will be uninterrupted, bug-free, or that messages will be delivered instantly. The Cooling Filter rewrites language — it is a communication tool, not therapy or counseling, and we don’t guarantee any specific relational outcome from using it. To the maximum extent allowed by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. If you have a statutory warranty where you live that can’t be disclaimed (common in the EU and some US states), that one survives.

9. Our liability to you

We can’t be responsible for things we couldn’t reasonably foresee (consequential, indirect, or special damages) — including things like profit you might have made if you’d read a nudge faster, or a visit plan that fell through because our server blinked.

Our total liability for any claim arising out of or related to the service is limited to the greater of (a) the fees you’ve paid us in the 12 months before the claim arose, or (b) fifty US dollars. Nothing in these terms limits liability we can’t limit by law — for example, liability for fraud or gross negligence where applicable.

10. You stand behind your own use

If someone else sues us because of something you did in the app (indemnification) — harassing another user, posting illegal content, breaching these terms — you agree to cover our reasonable defense costs and any settlement or judgment related to your conduct.

11. Governing law and disputes

These terms are governed by the laws of [GOVERNING_JURISDICTION], without regard to conflict-of-laws principles. If you’re a consumer in the EU, UK, or another jurisdiction with mandatory consumer-law protections, those protections still apply to you regardless of this clause.

Informal resolution first. If you have a dispute with us, email legal@tildawn.app before starting anything formal. Most things get fixed inside 30 days.

Arbitration (US users).If informal resolution doesn’t work and you’re in the United States, you and we agree to resolve disputes through binding individual arbitration (no jury, no class actions) under the American Arbitration Association’s consumer rules. You can opt out of this arbitration clause by emailing legal@tildawn.app within 30 days of first accepting these terms. Small-claims court is always available as an alternative.

EU / UK / other jurisdictions.If you’re outside the United States, nothing here overrides your right to bring a claim in your local courts under your local consumer-protection laws. The arbitration clause above does not apply to you.

12. Changes to these terms

If we change these terms in a way that materially affects you, we’ll notify you in-app and by email at least 30 days before the change takes effect. Continuing to use the app after a change means you accept it. If you don’t, you can delete your account.

13. The fine print

• Entire agreement. These terms, plus the Privacy Policy, are the whole agreement between you and us about TilDawn. They replace anything we’ve said informally.
• Severability. If a court finds any part of these terms unenforceable, the rest still applies.
• No waiver.If we don’t enforce a right once, we haven’t given it up.
• Survival.The parts of these terms that by their nature should continue after your account ends — liability caps, indemnity, governing law, disputes — do continue.
• Assignment.You can’t assign your rights under these terms without our consent. We can assign ours in the ordinary course of business (e.g., if we’re acquired).
